BP will pay, and won’t pay…

A federal appeals court upholds the per-barrel fine levied against BP and Anadarko for the Macondo oil spill:

The companies had appealed Barbier’s ruling, arguing in part that they should not be responsible for oil spilled as a result of failed equipment on the drilling rig, which was owned by Transocean Ltd. But as co-owners of the well, BP and Anadarko would be on the hook for resulting fines, the appeals court ruled.

That is the right ruling. If courts allowed corporate boundaries to stop liability for exploration, it would set up a shell game of risk containment.

Neither company will have to help restore the Louisiana shoreline from the degradation their canals and infrastructure has caused. Because Louisiana governor Bobby Jindal is in the pocket of the oil companies.
